Bu alışveriş sitesini kullanan ve alışveriş yapan müşterilerimiz aşağıdaki şartları kabul etmiş varsayılmaktadır:

Sitemizdeki web sayfaları ve ona bağlı tüm sayfalar (‘seyranhalı’) BAŞPINAR(ORGANİZE)OSB MAH. O.S.B 3.BÖLGE KAMİL ŞERBETCİ BLV. NO: 66 ŞEHİTKAMİL/ GAZİANTEP adresindeki POZİTİF İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ firmasının (Firma) malıdır ve onun tarafından işletilir. Sizler (‘Kullanıcı’) sitede sunulan tüm hizmetleri kullanırken aşağıdaki şartlara tabi olduğunuzu, sitedeki hizmetten yararlanmakla ve kullanmaya devam etmekle; Bağlı olduğunuz yasalara göre sözleşme imzalama hakkına, yetkisine ve hukuki ehliyetine sahip ve 18 yaşın üzerinde olduğunuzu, bu sözleşmeyi okuduğunuzu, anladığınızı ve sözleşmede yazan şartlarla bağlı olduğunuzu kabul etmiş sayılırsınız.

İşbu sözleşme taraflara sözleşme konusu site ile ilgili hak ve yükümlülükler yükler ve taraflar işbu sözleşmeyi kabul ettiklerinde bahsi geçen hak ve yükümlülükleri eksiksiz, doğru, zamanında, işbu sözleşmede talep edilen şartlar dâhilinde yerine getireceklerini beyan ederler.

1. SORUMLULUKLAR

a.Firma, fiyatlar ve sunulan ürün ve hizmetler üzerinde değişiklik yapma hakkını her zaman saklı tutar.

b.Firma, üyenin sözleşme konusu hizmetlerden, teknik arızalar dışında yararlandırılacağını kabul ve taahhüt eder.

c.Kullanıcı, sitenin kullanımında tersine mühendislik yapmayacağını ya da bunların kaynak kodunu bulmak veya elde etmek amacına yönelik herhangi bir başka işlemde bulunmayacağını aksi halde ve 3. Kişiler nezdinde doğacak zararlardan sorumlu olacağını, hakkında hukuki ve cezai işlem yapılacağını peşinen kabul eder.

d.Kullanıcı, site içindeki faaliyetlerinde, sitenin herhangi bir bölümünde veya iletişimlerinde genel ahlaka ve adaba aykırı, kanuna aykırı, 3. Kişilerin haklarını zedeleyen, yanıltıcı, saldırgan, müstehcen, pornografik, kişilik haklarını zedeleyen, telif haklarına aykırı, yasa dışı faaliyetleri teşvik eden içerikler üretmeyeceğini, paylaşmayacağını kabul eder. Aksi halde oluşacak zarardan tamamen kendisi sorumludur ve bu durumda ‘Site’ yetkilileri, bu tür hesapları askıya alabilir, sona erdirebilir, yasal süreç başlatma hakkını saklı tutar. Bu sebeple yargı mercilerinden etkinlik veya kullanıcı hesapları ile ilgili bilgi talepleri gelirse paylaşma hakkını saklı tutar.

e.Sitenin üyelerinin birbirleri veya üçüncü şahıslarla olan ilişkileri kendi sorumluluğundadır.

2. Fikri Mülkiyet Hakları

2.1. İşbu Site’de yer alan ünvan, işletme adı, marka, patent, logo, tasarım, bilgi ve yöntem gibi tescilli veya tescilsiz tüm fikri mülkiyet hakları site işleteni ve sahibi firmaya veya belirtilen ilgilisine ait olup, ulusal ve uluslararası hukukun koruması altındadır. İşbu Site’nin ziyaret edilmesi veya bu Site’deki hizmetlerden yararlanılması söz konusu fikri mülkiyet hakları konusunda hiçbir hak vermez.

2.2. Site’de yer alan bilgiler hiçbir şekilde çoğaltılamaz, yayınlanamaz, kopyalanamaz, sunulamaz ve/veya aktarılamaz. Site’nin bütünü veya bir kısmı diğer bir internet sitesinde izinsiz olarak kullanılamaz.

3. Gizli Bilgi

3.1. Firma, site üzerinden kullanıcıların ilettiği kişisel bilgileri 3. Kişilere açıklamayacaktır. Bu kişisel bilgiler; kişi adı-soyadı, adresi, telefon numarası, cep telefonu, e-posta adresi gibi Kullanıcı’yı tanımlamaya yönelik her türlü diğer bilgiyi içermekte olup, kısaca ‘Gizli Bilgiler’ olarak anılacaktır.

3.2. Kullanıcı, sadece tanıtım, reklam, kampanya, promosyon, duyuru vb. pazarlama faaliyetleri kapsamında kullanılması ile sınırlı olmak üzere, Site’nin sahibi olan firmanın kendisine ait iletişim, portföy durumu ve demografik bilgilerini iştirakleri ya da bağlı bulunduğu grup şirketleri ile paylaşmasına muvafakat ettiğini kabul ve beyan eder. Bu kişisel bilgiler firma bünyesinde müşteri profili belirlemek, müşteri profiline uygun promosyon ve kampanyalar sunmak ve istatistiksel çalışmalar yapmak amacıyla kullanılabilecektir.

3.3. Gizli Bilgiler, ancak resmi makamlarca usulü dairesinde bu bilgilerin talep edilmesi halinde ve yürürlükteki emredici mevzuat hükümleri gereğince resmi makamlara açıklama yapılmasının zorunlu olduğu durumlarda resmi makamlara açıklanabilecektir.

4. Garanti Vermeme:

İŞBU SÖZLEŞME MADDESİ UYGULANABİLİR KANUNUN İZİN VERDİĞİ AZAMİ ÖLÇÜDE GEÇERLİ OLACAKTIR. FİRMA TARAFINDAN SUNULAN HİZMETLER "OLDUĞU GİBİ” VE "MÜMKÜN OLDUĞU” TEMELDE SUNULMAKTA VE PAZARLANABİLİRLİK, BELİRLİ BİR AMACA UYGUNLUK VEYA İHLAL ETMEME KONUSUNDA TÜM ZIMNİ GARANTİLER DE DÂHİL OLMAK ÜZERE HİZMETLER VEYA UYGULAMA İLE İLGİLİ OLARAK (BUNLARDA YER ALAN TÜM BİLGİLER DÂHİL) SARİH VEYA ZIMNİ, KANUNİ VEYA BAŞKA BİR NİTELİKTE HİÇBİR GARANTİDE BULUNMAMAKTADIR.

5. Kayıt ve Güvenlik

Kullanıcı, doğru, eksiksiz ve güncel kayıt bilgilerini vermek zorundadır. Aksi halde bu Sözleşme ihlal edilmiş sayılacak ve Kullanıcı bilgilendirilmeksizin hesap kapatılabilecektir.

Kullanıcı, site ve üçüncü taraf sitelerdeki şifre ve hesap güvenliğinden kendisi sorumludur. Aksi halde oluşacak veri kayıplarından ve güvenlik ihlallerinden veya donanım ve cihazların zarar görmesinden Firma sorumlu tutulamaz.

6. Mücbir Sebep

Tarafların kontrolünde olmayan; tabii afetler, yangın, patlamalar, iç savaşlar, savaşlar, ayaklanmalar, halk hareketleri, seferberlik ilanı, grev, lokavt ve salgın hastalıklar, altyapı ve internet arızaları, elektrik kesintisi gibi sebeplerden (aşağıda birlikte "Mücbir Sebep” olarak anılacaktır.) dolayı sözleşmeden doğan yükümlülükler taraflarca ifa edilemez hale gelirse, taraflar bundan sorumlu değildir. Bu sürede Taraflar’ın işbu Sözleşme’den doğan hak ve yükümlülükleri askıya alınır.

7. Sözleşmenin Bütünlüğü ve Uygulanabilirlik

İşbu sözleşme şartlarından biri, kısmen veya tamamen geçersiz hale gelirse, sözleşmenin geri kalanı geçerliliğini korumaya devam eder.

8. Sözleşmede Yapılacak Değişiklikler

Firma, dilediği zaman sitede sunulan hizmetleri ve işbu sözleşme şartlarını kısmen veya tamamen değiştirebilir. Değişiklikler sitede yayınlandığı tarihten itibaren geçerli olacaktır. Değişiklikleri takip etmek Kullanıcı’nın sorumluluğundadır. Kullanıcı, sunulan hizmetlerden yararlanmaya devam etmekle bu değişiklikleri de kabul etmiş sayılır.

9. Tebligat

İşbu Sözleşme ile ilgili taraflara gönderilecek olan tüm bildirimler, Firma’nın bilinen e.posta adresi ve kullanıcının üyelik formunda belirttiği e.posta adresi vasıtasıyla yapılacaktır. Kullanıcı, üye olurken belirttiği adresin geçerli tebligat adresi olduğunu, değişmesi durumunda 5 gün içinde yazılı olarak diğer tarafa bildireceğini, aksi halde bu adrese yapılacak tebligatların geçerli sayılacağını kabul eder.

10. Delil Sözleşmesi

Taraflar arasında işbu sözleşme ile ilgili işlemler için çıkabilecek her türlü uyuşmazlıklarda Taraflar’ın defter, kayıt ve belgeleri ile ve bilgisayar kayıtları ve faks kayıtları 6100 sayılı Hukuk Muhakemeleri Kanunu uyarınca delil olarak kabul edilecek olup, kullanıcı bu kayıtlara itiraz etmeyeceğini kabul eder.

11. Uyuşmazlıkların Çözümü

İşbu Sözleşme’nin uygulanmasından veya yorumlanmasından doğacak her türlü uyuşmazlığın çözümünde İstanbul (Merkez) Adliyesi Mahkemeleri ve İcra Daireleri yetkilidir.

This Disclosure Text is primarily prepared in accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK") to explain:

1. What types of data (seyranhalı) collects through the website www.seyranhali.com ("www.seyranhali.com"), how your collected data is used, and with whom www.seyranhali.com may share your data;

2. What your rights are regarding the data processed by seyranhalı and how you can exercise these rights;

3. How you can change your positive or negative preferences regarding the receipt of electronic commercial communications.

In order to provide better service to you, our Members; to manage and complete your order processes and ensure communication with you; to provide information about products, services, campaigns, and promotions; to better understand your shopping preferences, perform trend and statistical analyses, and strengthen the security of the Site; and for the purpose of fulfilling our legal obligations arising from relevant legislation, including Law No. 5651 on Regulating Broadcasting in the Internet Environment and Fighting Against Crimes Committed through Such Broadcasting, Law No. 6563 on the Regulation of Electronic Commerce, the Turkish Penal Code No. 5237, and the Law No. 6698 on the Protection of Personal Data and their secondary legislation; we process certain data that directly or indirectly identifies the Member, including but not limited to your name, surname, e-mail address, telephone number, gender, date of birth, T.R. ID number, tax identification number, personal interests, billing and delivery addresses, and information authorized to be shared via social media channels if you connect through them.

Apart from this data, we collect and process aggregate statistical data that does not contain personal information, such as the frequency and times of Site visits, order times and IP addresses at the time of ordering, and statistics of visited product pages and ordered products, for the purpose of analyzing and understanding visitor movements and preferences.

We process and store this personal data so that you can benefit from the services offered on the Site, provided that your explicit consent is obtained, or if it is directly related to the establishment or performance of the contract we have with you, or if data processing is mandatory for our legitimate interests without harming your fundamental rights and freedoms, within the scope and purposes determined by this KVKK Disclosure, and by taking appropriate information security measures.

We use certain data collected in our database in accordance with relevant legal regulations for periodic campaign activities to be sent at certain intervals, the design of special promotional activities for customer profiles, and customer classification studies to prevent the transmission of unsolicited e-mails.

When you use a credit card to pay for a product, you agree to share your credit card number, expiration date, CVV2 code, and similar information with banks. However, credit card and/or debit card information used during order creation is not stored in our systems in any way.

If you request a customer record to be created by providing your contact information in our stores, your personal data may be collected verbally during your meetings with store employees. Your personal data collected within the scope of customer registration processes may be used to verify your contact information; and in line with your explicit consent, it may be processed to create special campaigns and promotions suitable for your consumer behavior, to directly transmit commercial electronic messages for marketing purposes regarding our products and services, and to create and track necessary records in our systems to facilitate your return and exchange processes.

www.seyranhali.com is free to keep any record belonging to a terminated membership account, provided that it is anonymized. Once data is anonymized, it loses the characteristic of identifying a person and is not considered personal data in this sense. The Member cannot claim any rights or compensation regarding anonymized records.

We may share your personal data with third parties (companies providing cargo, delivery, call center, database, etc. services) with whom we cooperate to provide our services, and with state authorities as required by our legal obligations. www.seyranhali.com may share your personal data regarding your visit to the Site or membership, and traffic information such as your browsing information, with public institutions and organizations legally authorized to request this information for your security and to fulfill www.seyranhali.com's legal obligations. However, we will not use your personal data for any commercial purpose or share it with third parties, except for the activities listed above and cases required by the relevant legislation.

www.seyranhali.com is obliged to keep Member information that it must legally store. Nevertheless, the Member’s rights to be informed about their personal data, to access this data, to request its correction or deletion, and to request information on whether it is used in accordance with its purposes are reserved.

To the extent that your personal data is processed by www.seyranhali.com and www.seyranhali.com processes your data as a data controller, in accordance with Article 11 of the KVKK, you may apply in writing to the contact address on the contact page, or by sending an e-mail to www.seyranhali.com using a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the e-mail address you shared with us during membership and which is registered in our systems, to exercise the following rights:

1. Learn whether any of your personal data is being processed;

2. Request information regarding personal data processing activities;

3. Learn the purposes of processing your personal data;

4. Learn the third parties to whom personal data has been transferred domestically or abroad;

5. Request correction of personal data if it is incomplete or incorrectly processed;

6. Request the deletion or destruction of personal data if the reasons requiring processing no longer exist or if the Company lacks a legal basis or legitimate interest to process said data;

7. Request the Company to ensure that third parties authorized by the Company and processing personal data respect your rights under this section;

8. Object to adverse results that may arise from the processing of personal data through automated systems; and

9. Request compensation for damages if you suffer a loss due to the unlawful processing of your personal data.

You can always update your membership and communication preferences by logging into the system.

www.seyranhali.com takes necessary precautions against unauthorized access to personal data or the loss, misuse, disclosure, alteration, or destruction of this information for the purpose of protecting personal data. It undertakes to keep your personal data confidential, to take all necessary physical, technical, and administrative measures to ensure confidentiality and security, and to show due diligence. Despite taking the necessary information security measures, if personal data is damaged or falls into the hands of third parties as a result of attacks on the Site and the system, it will immediately notify you and the Personal Data Protection Board and take the necessary measures.

www.seyranhali.com may make changes to this KVKK Disclosure at any time. These changes become effective immediately upon the publication of the revised new provisions and/or policies on the Site. In the event of such a change, you, our members, will be informed accordingly.
